Terms and Conditions v2.0
Effective: 10 April 2026
Bawtt is operated by Bawtt Pty Ltd (ACN 697 022 129) (“we”, “us”, “our”).
The rules. Not exciting. Still binding. Rules are like speed limits — nobody loves them, but things get messy (and expensive) when you ignore them. So yes, they’re annoying… but they’re also the reason Bawtt doesn’t turn into chaos. Don’t be the reason we can’t have nice things.
The Deal
By using Bawtt (website, app, extension, features — any of it), you agree to these Terms and Conditions, our Content Policy, Advertiser Policy, Privacy Policy, and any additional terms and conditions that apply to specific functions of Bawtt (together, the “Terms”). If you don’t agree, don’t use Bawtt. Simple.
If you use Bawtt for a business or anyone else, you promise you have authority to bind them — and you personally are still on the hook for what you do.
We can update our Terms any time. Changes take effect when posted on Bawtt. If you keep using Bawtt after changes, you accept the new Terms.
Definitions (What We Mean by Things)
To keep this readable, here are the key definitions:
- Advertiser(also referred to as Commercial User) — any person or entity that posts, places, submits, promotes, sponsors, or otherwise makes Content available on or through Bawtt for its own Commercial Benefit, or for the Commercial Benefit of any third party, whether or not the Advertiser receives payment or commission directly. An Advertiser includes, without limitation: affiliates and referral partners; advertisers and sponsors; merchants, retailers, brands, and service providers; employees, contractors, representatives, agents, influencers, ambassadors, PR firms, or agencies acting for a business or brand; and any person posting Content as part of a marketing, promotional, traffic driving, lead generation, or brand awareness activity.
- Advertiser Content— any Content that is posted, submitted, displayed, communicated, or otherwise made available on or through Bawtt by or on behalf of an Advertiser, or by any person acting for an Advertiser, where the Content is connected with, or gives rise to, any Commercial Benefit. Advertiser Content includes, without limitation: sponsored, promoted, boosted, or paid placements; affiliate, referral, tracking, or commission based links, codes, or identifiers; content promoting the Advertiser’s own or a third party’s business, products, services, listings, or brand; content distributed to generate leads, traffic, sign-ups, subscriptions, or brand exposure; and any associated links, creatives, text, images, metadata, tracking parameters, calls to action, or landing pages. Advertiser Content does not include Content posted by an Ordinary User solely for personal, informational, or community purposes, where no Commercial Benefit is obtained other than an ordinary consumer discount on the User’s own purchase.
- Commercial Benefit— any direct or indirect financial, economic, marketing, promotional, or other advantage arising from the posting or promotion of Content. Commercial Benefit includes, without limitation: commissions, referral fees, affiliate income, or revenue share; tracking, attribution, or performance based benefits; sponsorships, paid placements, or free or discounted products provided in exchange for promotion; lead generation, traffic driving, sign-ups, subscriptions, or data collection; brand awareness, reputation management, or promotional exposure; and any similar marketing or commercial advantage. Commercial Benefit does not include an ordinary consumer obtaining a discount, cashback, reward, coupon, or saving solely on their own purchase, where neither the poster nor any third party they are acting for receives any commission, referral income, attribution benefit, or promotional advantage from other Users’ engagement or purchases.
- Affiliate— anyone posting Deals/links that generate commissions or other benefits (including referral fees, influencer codes, cashback, “partner” links, or tracking links), whether disclosed or not.
- Bawtt— Bawtt Pty Ltd and the Bawtt platform in all forms (app, website, extension, tools, features).
- Content— anything posted, uploaded, transmitted, or displayed on Bawtt (text, images, codes, links, votes, comments, metadata, deal info, etc.).
- Deal— any offer, discount, promotion, listing, coupon, code, price drop, bundle, service offer, or similar.
- Ordinary User— a User who shares, discusses, or comments on deals, offers, or information for personal, informational, or community purposes only, and who does not obtain any Commercial Benefit other than an ordinary consumer discount on their own purchases.
- Policies— any policies or rules we publish (including Community Rules, reporting requirements, affiliate disclosure requirements, and any product-specific terms).
- Third-Party Website— any website or service not operated by us (including retailers, payment providers, app stores, advertisers).
- User— you (and everyone else using Bawtt).
Who Can Use Bawtt (Eligibility)
You must be 18+ and have legal capacity to enter a binding agreement where you live. If you’re under 18, you may only use Bawtt with parent/guardian supervision and their agreement to these Terms.
You must comply with all applicable laws (including consumer, advertising, privacy, IP, misleading/deceptive conduct). You must comply with the Australian Consumer Law and advertising standards, and Affiliates and Advertisers are held to a higher standard on Bawtt.
What Bawtt Is (and Isn’t)
Bawtt is a community-driven deal discovery platform: Users post, discuss, and discover Deals.
We are an information-sharing service only. We are not a seller, supplier, agent, broker, or intermediary to your purchases. We don’t sell products, process transactions, guarantee prices, stock, availability, or accuracy.
All Deal information, third party or User Content and pricing, discounts and claims originate from third parties and are not reviewed or guaranteed by Bawtt. Content may be inaccurate, incomplete, outdated, or unavailable.
Bawtt does not: supply the goods or services of third parties; act as agent, broker, intermediary or adviser; verify, approve, audit, or endorse any deal or Content.
Bawtt is not: a price guarantee service; your shopping advisor; your accountant; your mother.
To the maximum extent permitted by law, Bawtt and all Content are provided “as is” and “as available”. We make no warranties about accuracy, completeness, availability, reliability, or fitness for purpose.
Your Account (Security, Responsibility, Ban-Evasion)
If you wish to access certain features on Bawtt, you must register for a User account. You are required to provide accurate, current, and complete information during registration and must promptly update any changes to ensure your account details remain accurate. Failure to provide accurate or current information may result in suspension or termination of your account.
You are solely responsible for maintaining the confidentiality of your login credentials, including your username and password. You agree to take reasonable precautions to secure your account from unauthorised access. You are fully responsible for all activities that occur under your User account, whether or not such activities have been authorised by you.
You’re responsible for your account, password, and anything done through it. If you suspect compromise, tell us immediately. No ban evasion: if we suspend/ban you, you must not create a new account or use someone else’s account to sneak back in. If you do, we’ll remove you again — faster.
We reserve the right, at our sole discretion, to suspend, restrict, or terminate your User account at any time if we reasonably believe that you have breached our Terms; your account is involved in fraudulent, abusive, or unlawful activities; your information is found to be inaccurate, incomplete, or outdated; we are required to do so by applicable law or regulatory authority; or any activities under your account put the security, integrity, or functionality of Bawtt or our Users at risk.
Your Content (Public, Your Problem, Our Licence)
Responsibility for Content
All Content is public and may be viewed, shared, and reused by others. Once it’s out, you may not be able to fully claw it back. You are solely responsible for Content you post. You promise your Content is lawful, accurate, and doesn’t infringe anyone’s rights. The fact Content appears on Bawtt does not mean we reviewed, verified, or endorsed it.
Deals change. Stock disappears. Mistakes are made. Verify before you buy. You rely on Content at your own risk.
You allow us to display your username/handle with your Content and in promotions of Bawtt, but we do not have to do so.
If You Post a Deal, You’re Warranting Stuff
If you post a Deal/Content, you warrant to us: it’s accurate and not misleading or deceptive; the deal exists at the time you post it; “was/now” claims are real and substantiated; you have rights/permissions to post it; and you comply with all laws (including the Australian Consumer Law).
You must not:
- Use any automated means, including but not limited to robots, spiders, or scrapers, to access, monitor, or copy any part of Bawtt, or reproduce, download, or harvest Content beyond permissions afforded to you under our Terms
- Upload, post, transmit, or otherwise make available any Content that is illegal, defamatory, obscene, offensive, misleading, harmful, fraudulent, infringing, or violates applicable laws
- Use Bawtt in any manner that could harm, disrupt, overburden, disable, or otherwise compromise Bawtt or its underlying systems, including by sending unsolicited communications (spam)
- Attempt to gain unauthorised access to any portion of Bawtt, Bawtt servers, or data belonging to other Users, or interfere with security-related features or functionality
- Use Bawtt for any unlawful, fraudulent, or prohibited activity
Bawtt reserves the right to monitor activities on Bawtt to ensure User compliance with our Terms. Any breaches of our Terms or misuse or unauthorised use of Bawtt may result in the immediate suspension or termination of your User account, without notice, along with additional legal or regulatory action if applicable.
Licence You Grant Us
By submitting Content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable and sublicensable licence to use, host, store, reproduce, modify, adapt, publish, translate, distribute, communicate, display and create derivative works from your Content in any media and formats now known or later developed, for the purpose of operating, improving, securing, promoting, monetising and commercialising Bawtt.
To the extent permitted by law, you consent to any act or omission by us (or our licensees) that might otherwise infringe your moral rights in your Content, including editing, formatting, cropping, or adapting it.
If you give us suggestions/ideas/feedback, you grant us a perpetual, worldwide, royalty-free licence to use it without compensation or attribution. This licence continues even if you stop using Bawtt, or delete Content.
Links, Tracking and Platform Control
Bawtt reserves the right, at its sole discretion, to review, modify, edit, or replace any Content provided by Users, including but not limited to altering or replacing any links submitted by Users. This includes ensuring compliance with our Terms, and applicable laws and regulations.
You acknowledge and agree that Bawtt is not responsible for the functionality, accuracy, availability, or maintenance of any affiliate links, external links, or other third-party links provided by Users or displayed on Bawtt. You are solely responsible for ensuring that any links you provide are accurate, functional, and comply with all applicable laws and regulations.
You acknowledge that: you have no entitlement to the preservation, visibility, priority, or integrity of any link you submit; we are not obliged to route traffic in accordance with your preferences; and you must not attempt to bypass, obscure, or interfere with link-level controls applied by us.
Bawtt is for real deals, not manipulation or harassment. You must not:
- Post fake/misleading deals or fabricated “was/now” pricing
- Spam affiliate links with no genuine value
- Game votes, rankings, engagement, or visibility (including coordinated upvotes, brigading, vote rings)
- Use bots, scraping, automation, data mining, or harvesting tools
- Create multiple accounts
- Manipulate outcomes
- Impersonate anyone or misrepresent affiliation
- Post illegal, restricted, dangerous, recalled, counterfeit, or stolen goods/services
- Post malware, harmful code, phishing links, or scam content
- Dox, harass, threaten, or invade privacy
- Harass, annoy or stalk any other users
- Use Bawtt to breach any third-party terms or laws
- Copy, scrape, reverse engineer, exploit, resell, or commercially reuse Bawtt or any part of it without written consent
We may (to the extent permitted by law), without notice and without answering to you: remove/edit Content; reduce visibility or ranking; restrict features; block devices/IPs; refer matters to law enforcement or regulators; take legal action for abuse, scraping, fraud, or IP infringement; and use technical means to enforce our rights and our Terms.
Termination and Suspension and Deactivation
Bawtt may, at its sole discretion, suspend, restrict, or terminate your access to Bawtt or User account at any time, with or without prior notice, for reasons including but not limited to: any breach or violation of our Terms; non-compliance with applicable laws and regulations; fraudulent, abusive, or unlawful conduct; submission of inaccurate, incomplete, or outdated information; actions that compromise the security, integrity, or lawful operation of Bawtt or infringe the rights of other Users, third-party entities, or Bawtt itself; or if we reasonably believe we are required to comply with legal obligations, court orders, or requests from government authorities.
You may request the deactivation of your User account at any time by contacting Bawtt through the reporting system on Bawtt, or designated contact channels. Upon receipt of such a request, Bawtt will take reasonable steps to deactivate your account and delete or anonymize your personal information in accordance with applicable privacy laws and our Terms.
Bawtt will not be liable for any loss, damage, or inconvenience suffered by you or any third party as a result of suspension, termination, or any other action taken by Bawtt under our Terms, to the extent permitted by law.
Commercial Content: Affiliates & Advertisers (Extra Rules, Less Patience)
If you post as an Affiliate or Advertiser or have a commercial interest, you must: clearly disclose any material commercial connection (commission, referral fee, sponsorship, free product, code, etc.); comply with Australian Consumer Law and ad standards; ensure claims are true, substantiated, and not misleading; comply with our Policies and any affiliate/advertiser program terms.
We may label, rank, prioritise, downrank, or remove Deals for commercial, quality, integrity, or strategic reasons. Not every Deal shown is “the best” Deal.
You acknowledge and agree that we may treat you as an Advertiser or Commercial User for the purposes of our Terms where, in our reasonable opinion, your use of Bawtt involves or gives rise to any Commercial Benefit. This applies whether or not you describe or hold yourself out as an Advertiser; you receive payment or commission directly; or the Commercial Benefit is obtained by you or by any third party you are acting for or assisting.
If we reasonably determine that you are acting as an Advertiser, you are subject to the Bawtt Advertiser & Commercial Posting Policy as Additional Terms.
Ownership (Ours vs Yours)
We own Bawtt (platform, branding, code, UI, features, databases, look and feel), excluding User/Affiliate/Advertiser generated Content. We don’t promise Bawtt will be uninterrupted, secure, or error-free. Outages happen. Bugs happen. The internet is held together with tape.
Subject to any prior written agreement between us, you get a limited, revocable, non-exclusive licence to use Bawtt for personal, non-commercial purposes — only while we allow it.
We may modify, suspend, restrict, or discontinue any part of Bawtt at any time, with or without notice, to the extent permitted by law. Nothing in our Terms creates any obligation on us to continue offering any feature, service, or rule set in any particular form or at all.
Privacy
Content on Bawtt is public, and other Users can see what deal you have added, saved and what and who you follow and who follows you. We handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy.
Paid Services (If We Charge You For Fancy Stuff)
Most of Bawtt is free, but we may offer paid features, subscriptions, boosts, or services (“Paid Services”). Paid Services may have Additional Terms, pricing, billing cycles, and eligibility rules. Those Additional Terms form part of these Terms.
Billing & renewals: if Paid Services are subscription-based, you authorise recurring charges until cancelled. Refunds: unless required by law, fees are non-refundable. Where consumer guarantees apply, they apply. App Stores: if you download Bawtt via Apple/Google, their terms also apply.
Additional Terms (Yes, Sometimes There Are More Rules)
Certain features, services, promotions, paid offerings, competitions, beta tools, integrations, or third party functionality may be subject to additional terms, policies, guidelines, or program rules (“Additional Terms”). If Additional Terms apply: we’ll tell you (or make them available) before you use that feature; and by using that feature, you agree to those Additional Terms. If there is any inconsistency between these Terms and any Additional Terms, the Additional Terms prevail, but only for that specific feature or service.
Limitation of Liability
To the full extent permitted by law, Bawtt excludes all representations, warranties or guarantees, express or implied, including those regarding: the accuracy, completeness, reliability, or timeliness of any Content, including third party Content displayed or hosted on Bawtt; the fitness for any particular purpose or merchantability of any goods, services, deals, offers, or discounts provided, linked, or advertised via Bawtt; the security, functionality, or uninterrupted availability of Bawtt; and compliance of third party Content or links with applicable laws, standards, or privacy regulations.
Bawtt is not liable for any direct, indirect, incidental, special, consequential, or punitive damages (including loss of profits, reputation, data, or goodwill) arising from or in connection with: your access to, use, or inability to use Bawtt; reliance on any information, deals, offers, or third party Content presented on Bawtt; inaccuracies, errors, omissions, or misrepresentations in third party Content or links; third party goods, services, deals, discounts, or offers supplied or linked through Bawtt; unauthorised access or modification of Content, your User account or data stored within Bawtt; or use of automated tools in violation of our Terms.
Where liability cannot be excluded under applicable law, Bawtt’s liability is limited, at our sole discretion, to: the resupply of access to Bawtt; providing technical support to rectify access issues; or reimbursement of any fees paid directly to Bawtt by the User for Bawtt access, up to a maximum aggregate amount of AUD $100.
Indemnity
You indemnify Bawtt and its officers, employees, agents, successors, and assigns against any and all loss, liability, damage, expense, claim, cost, or demand (including reasonable legal costs and defence expenses) that arises from or is connected with: your access to or use of Bawtt; any breach by you of our Terms or any applicable law or regulation; any Content you upload, post, submit, transmit, or otherwise make available via Bawtt; your misuse or unauthorised use of Bawtt; third-party claims arising from your conduct or interactions with third party Content, links, deals, or advertisements; and any activity under your User account.
This indemnity survives the termination or suspension of your User account, your use of Bawtt, or our Terms.
Intellectual Property
All intellectual property rights in Bawtt, including but not limited to software, source code, algorithms, databases, text, graphics, user interface elements, logos, designs, trade marks, trade names, and branding, are owned or licensed to Bawtt or our licensor. No transfer of intellectual property rights is made to you as a result of your use of Bawtt, except where explicitly agreed otherwise in writing.
Content originating from third parties remains the property of those third parties. You agree that you will not duplicate, modify, publish, transmit, distribute, create derivative works from, or exploit such Content in any way, except where authorised by the respective third-party owner or permitted by law.
Nothing in our Terms grants you rights to use any trade marks, trade names, service marks, or logos displayed on Bawtt without prior written consent from the respective owner.
Intellectual Property Complaints (Copyright / Trade Marks) — Takedowns
We respect IP rights. If you believe Content on Bawtt infringes copyright, trade mark, or other IP rights, send us a notice through our online forms. Include: your name and contact details; the IP right you own/control; the exact URL(s) / screenshots identifying the Content; an explanation of why it infringes; a statement you have a good-faith belief the use is unauthorised; and a statement the information is accurate.
We may remove or disable access to the Content, request more information, or take any other action we consider appropriate — including account action — without notice and without liability, to the extent permitted by law. If you repeatedly infringe IP rights, we may suspend or permanently terminate your account. If you send bogus or abusive notices, we may reject them and take action against you.
Disputes and Complaints
If you have an issue, use the reporting tools or email the appropriate channel. If a dispute arises, a party must notify the other in writing with details. We must both attempt good faith resolution within 10 business days. If unresolved, either party may refer it to mediation through a recognised Australian disputes body (e.g., Australian Commercial Disputes Centre). Nothing prevents either party seeking urgent injunctive/equitable relief.
Force Majeure (When the Universe Says “No”)
We are not liable for delays, failures, or disruptions caused by events beyond our reasonable control (including outages, third-party failures, cyber incidents, strikes, natural disasters, war, government action, internet failures, or zombie invasions).
General (Boring But Important)
- Governing law: Our Terms are governed by the laws of Queensland, Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
- Severability: If any provision of our Terms is invalid/unenforceable, it is severed and the rest continues.
- Entire agreement: Our Terms are the entire agreement between you and us about Bawtt.
- Assignment: We may assign our rights without restriction. You may not assign without our written consent.
- Notices: We may notify you via Bawtt or email. You must notify us via legal@bawtt.com.
- Survival: The following provisions survive termination: ownership and intellectual property provisions; licences you granted to us; disclaimers, exclusions, and limitations of liability; indemnities; dispute resolution, governing law, and jurisdiction; enforcement rights and remedies; and any obligations that by their nature are intended to survive.
